ATF demand letters are formal requests for information from FFL dealers that are authorized by statute and require mandatory compliance. Unlike subpoenas, which are judicial process, demand letters are administrative demands — but they carry legal weight and non-compliance has consequences.
Types of ATF Demand Letters
ATF issues several categories of demand letters to FFL dealers. The most commonly encountered is the multiple sales demand letter, which requests information about transactions that triggered multiple handgun sales reporting requirements. ATF may also issue demand letters requesting information about specific firearms in connection with traces or investigations.
Demand letters are mandatory. Unlike some other ATF requests, demand letters issued under specific statutory authority are not optional. Failure to respond within the required timeframe or providing incomplete responses can result in compliance consequences including license revocation proceedings.
Multiple Sales Demand Letters
If ATF identifies a pattern of multiple handgun sales at your dealership that warrants further review, they may issue a demand letter requesting information about specific buyers, transactions, or patterns. The letter will specify exactly what information is required and the deadline for response.
Responding to a Demand Letter
Respond within the timeframe specified. Provide complete information for each item requested — incomplete responses that technically acknowledge the letter without fully addressing the requests are not sufficient. If you need additional time to gather complete records, contact ATF before the deadline to request an extension rather than missing the deadline without notice.
Seeking Legal Advice
If a demand letter relates to an investigation or requests information that could implicate you or your business in potential violations, consult a firearms attorney before responding. The attorney can help ensure your response is complete and appropriate without creating additional exposure.
